SOME STATES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATIONS MAY NOT APPLY TO RESIDENTS OF SUCH STATES. IN SUCH CASES, LIABILITY SHALL BE LIMITED TO THE FULLEST EXTENT PERMITTED BY LAW.

11.4 Exceptions to Arbitration

Notwithstanding the foregoing, either party may seek emergency injunctive or other equitable relief in a court of competent jurisdiction to prevent irreparable harm pending arbitration, and claims that fall within the jurisdiction of small claims court may be pursued in that forum.
